Is copyright registration required for legal protection?

Literary and artistic works created by authors and artists through their own ideas and creative expression shall be protected under copyright law from the things are expressed. The main purpose is that copyright protection shall arise only where the work constitutes the original creation of its author. Under copyright law, the acquisition of copyright protection for literary and artistic works does not require registration with the Intellectual Property Department (IPD). The author shall automatically enjoy copyright protection in a work immediately upon its creation, without any requirement for formal registration or other procedural formalities. While copyright protection vests automatically in the author upon creation of a work, registration with the Intellectual Property Department serves as the most effective means of evidencing ownership and preventing infringement, thereby facilitating enforcement of the author’s rights.

In Myanmar, completing a trademark registration usually requires approximately 12 to 18 months. After the application is filed, it must pass through several stages, including a formal check, a detailed substantive review, and a two-months publication period. When the application is clear of mistakes, objections, or oppositions, the overall process generally takes around one year based on the current IPD processing timeframe.

Industrial designs are protected through formal registration with the competent IP authority, provided the design is new and non-functional. Registration grants the owner exclusive rights over the appearance of the product, including its shape, configuration, lines, and ornamentation. The owner may prohibit unauthorized making, selling, or importing of any design that is identical or substantially similar. Once registered, the design becomes enforceable, allowing the owner to seek injunctions, damages, and other legal remedies.

Under the Myanmar Trademark Law 2019, trademark owners can enforce their rights by first confirming their legal ownership through registration and collecting proof of infringement. The usual first step is to send a cease-and-desist notice asking the infringer to stop the unauthorized use of the mark. If the issue continues, the owner may file administrative or civil actions with the Intellectual Property Department or the court to request injunctions, removal of infringing products, and compensation for damages. For serious or intentional infringement, the owner may also pursue criminal action, which can result in fines or imprisonment for the offender. In addition, the law allows trademark owners to request border-control measures to block counterfeit goods from being imported or exported. These legal options provide a clear and effective way for businesses to protect and enforce their trademarks in Myanmar.
